It is no longer possible to buy New Mexico Lottery tickets online safely or legally.

Previously, the New Mexico Lottery Authority permitted online ticket sales indirectly through a Memorandum of Understanding with Jackpocket, a third-party app that purchases physical tickets on behalf of customers.

However, Jackpocket exited the New Mexico market in 2025 after the Office of the Attorney General issued an opinion stating that the app violated state gambling laws and constituted a breach of state-tribal gaming compacts.

The Jackpocket app launched in New Mexico in April 2022 after the New Mexico Lottery Authority consulted legal counsel and determined the service complies with all state and federal laws.

Jackpocket became New Mexico’s highest-selling lottery retailer within three months as monthly sales broached $410,000. That’s in comparison to the next two highest retailers, which had sales of around $70,000.

In early 2024, a local chapter of Stop Predatory Gambling mounted a pressure campaign to shut down the Jackpocket New Mexico app, but they have had no success to date.

As a New Mexico Lottery spokeswoman put it when asked about Jackpocket:

“It is not a New Mexico Lottery app. You may want to reach out to Jackpocket or Circle K to discuss. We in no way have anything to do with the app. All tickets are purchased in person, at a Circle K retailer in Albuquerque, which meets the requirement.”

One year later, the Attorney General’s office issued the opinion that resulted in Jackpocket ceasing its New Mexico operations.

The New Mexico Department of Justice issued the opinion in response to inquiries from the governor and numerous tribal leaders questioning if Jackpocket is legal and whether its operations constitute a violation of New Mexico’s Tribal-State Class III Gaming Compact.

Attorney General Raúl Torrez determined that Jackpocket and its Memorandum of Understanding (MOU) with the New Mexico Lottery Authority (NMLA) were problematic in four aspects:

  1. The Jackpocket app constitutes “internet gaming,” which triggers a clause in the tribal-state gaming compact requiring the state to reopen “good faith negotiations” with the tribe and consider amending the compact.
  2. Jackpocket’s services violate state laws prohibiting the practice of accepting fees for transmitting funds for gambling or pari-mutuel wagering on “any unknown or contingent future event or occurrence whatsoever”
  3. Jackpocket also violates state laws prohibiting the sale of lottery ticket without written authorization from the NMLA CEO
  4. The Jackpocket business model violates state laws prohibiting selling or reselling lotter tickets without a certificate of authority from the NMLA

The New Mexico Lottery offers fewer games than most state lotteries, but the options cover several mainstay categories:

  • Mega Jackpot Draw Games: Powerball, Mega Millions, and Lotto America
  • State-Operated Jackpot Game: Roadrunner Cash
  • Daily Drawings: Pick 3 and Pick 4
  • Scratchers: 40+ scratch cards ranging from $1 to $20
  • Fast Play: Instant win games with results printed on the ticket

The New Mexico Lottery hosts frequent second chance drawings via My Rewards, where players can submit non-winning tickets for entries to win prizes ranging from free tickets to significant cash prizes.

For example, several recent NM Lottery second-chance drawings offered top prizes of up to $500,000 alongside smaller prizes, including free tickets, gift cards, and secondary cash prizes.

The New Mexico Lottery has three prize tiers that determine how players may claim prizes:

  • Prizes up to $600: In-person at any New Mexico Lottery retailer or via mail (no claim form required)
  • Prizes of $601 to $99,999: In-person at the NM Lottery headquarters in Albuquerque or via mail with a completed claim form (see the mail claim address below)
  • Prizes of $100,000+: In-person at the Lottery headquarters

The New Mexico Lottery warns players that prize payments of $1,000,000 or more may be delayed by three weeks or more.
